This General Counsel position provides legal support to all Divisions and programs within the Department of Health, which includes the Division of Administration, Family & Community Health, and Healthcare Access & Quality and Health Protection. It also provides support to the department's 13 licensing boards. The position will also provides support or supervision to other legal staff in the department. The incumbent will also serve as a Special Assistant Attorney General (SAAG). Duties include providing legal opinions and advice to department staff; drafting legislation and administrative rules; assisting with the Request for Proposals process; ensuring the department is in compliance with federal and state statutes and administrative rules; participating in administrative and court hearings associated with regulatory actions involving health care facilities, food service establishments, lodging establishments, and campgrounds; providing assistance in drafting contracts and joint powers agreements; and other duties as assigned by members of Executive Management.
Must have the ability to travel as needed.
This position is exempt from the Civil Service Act.
Licenses and Certifications:
Graduation for an accredited school of law and a member of the South Dakota State Bar or eligible to sit for the exam is required.
The Ideal Candidate Will Have:
At least eight years practicing law including experience supervising or providing work direction to attorneys. Experience in health care, public health and administrative law is desirable.
Knowledge, Skills, and Abilities:
- Ability to communicate effectively, work as a team member, and manage a large and complex caseload is essential.
